Might be a different story with 2 other people there to back their side up,
But say it had have been 1 robber V the owner with the .22 Could he not just say i warned him and he tried to attack me so i shot him to defend myself. Is this enough to save yourself in court, who's to prove it wasn't self defense? I've thought about this sort of situation before.
