I would say it started in the 90's as that was when I started noticing the litigation culture starting to hit.

I think incidents like these are a good lesson in life, mess with the wrong things or mess with something/someone the wrong way and you are going to suffer the consequences.

Sometimes the Gene Pool needs the extra chlorine.

Anybody ever make the bolt bombs? I remember getting a nut and bolt from a bridge that was having work done it, was given to me by one of the bridge workers. That made the best bolt bomb ever, the amount of caps we could fit into that baby.

Oh no, time to ban the old caps

I wouldn't call it dumb parents breeding dumber kids. Kids are kids and will hurt themselves. Its people over reacting when something bad happens.

The over-reaction by people brings in these bans. Its funny how people are up in arms about this, yet start to call for laws against (or someone's job) things when low percentage incidents happen.

They are already moving towards this in the NT (banning cask wine). Last year you had to have your ID listed down if you tried to buy over $100 worth of takeaway grog.

The latest is now when you buy takeaway (any amount) they scan your licence and if it comes up that you're on a list of problem drinkers, they aren't allowed to sell it to you.

Of course, the ad's on the tele say "don't worry, they don't keep your details"........ Uh huh......

Every year the chorus of people wanting fireworks banned up here increases because of the inconvenience and danger. As with anything, it's the idiots that spoil it for everyone else.

I feel sorry for the boy and the parents concerned and most of us have probably done something equally as stupid in our younger days (i know I did).

But you can't legislate against stupidity. People will always find new and interesting ways to hurt themselves.

I've heard of a kid needing his spleen removed from a BMX accident, I believe there has been a death too. Better ban BMX's.
I nearly broke my ankle once during a high bunny-hop competition with my mates using bread crates. We better ban bread too.

I see on the news that a lot of people have died from car accidents cause they were not used as intended. Better ban cars.

Blame the media - any story that can be beaten up and run for as long as possible can also be used as an avenue for people to also off load any obligations in regard to any form of common sense or responsibility they think they may have.

I blame the parents, I blame the poor sod who made the decision to light the sparklers in the first place.

I blame the Margaret River Council for letting me make the wrong decision when taking off on a fifteen foot faced wave in awesome conditions, that resulted in a heavy price to pay - what has to happen -place a fence around the reef, that will stop some one else getting hurt.

This has always been a gagging issue with me - a news story, legislate & ban all things that could possibly harm one self - unfortunately the Nanny State mentality will rule supreme one day then big brother will surely look after every one's needs

Legislate against stupidity and taking responsibility for one's own actions - now that's something I could vote for.

End of rant - now taking a bex and having a lie down.

PS -I have nothing agains't the poor guy who unfortunately has seriously injured himself - hopefully all goes well.

Litigation hit its peaks in the USA in the late 1980s... it slowly migrated across the ocean to Australia and took up residence.

At the end of the day kids will be kids, as everyone has stated, we all did it (which doesnt make it right) and we all hopefully learned from our mistakes.

If we hurt ourselves our parents (mostly) would tell you off for nearly killing yaself and that was it. Nowadays we prefer to blame someone else and milk it for what its worth...

the line between too cautiouse and not enough is a hard one, when i was a young buk we had penny bangers, quite large crackers, i would imagine they were banned long ago now, the power of these was terrific, i remember sticking a single penny banger under my plastic cowboy hat,and blew the top right out of it, fireworks or sparklers should be used with adult supervision for sure not banned though.

The best one I seen was empty bullet casings filled with that powder in cap gun caps, 2006 a mate took a couple into school, and we where egging another of our mates to detonate it, it took all recess, but by the time he got the courage to actually do it, his hand went up, the massive rock went down and a teacher stepped right out of the classroom we where right in front of, it detonates the moment he opens the door...

WAS THAT A REAL BULLET? ALL OF YOU GET INSIDE NOW!

Then we all got yelled at, he went absolutely nuts and the guy who made them and the guy who set it off got suspended for 2 weeks, good times.

Stupidity and passivity is breeding a generation of molly coddled emo's. Coupled with a media more concerned with trivial garbage such as a sparkler incident; shows like ACA and Today Tonight which inform the ignorant with false causes and campaigns designed to further erode our independent thought.
Facts are, kids are inquisitive and try stuff and some get hurt, but never make the same mistake again. Blanket bans on products because one single idiot got hurt are nothing short of the ideals and mechanations of the socialists; "we're taking another of your freedoms - don't worry, we believe it will be good for you". The dumb part about it is, the precedent has already been set years ago and slowly but surely, our freedom is being replaced with conformity at the hands of regulatory tribunals and governments.

Think about it, there'll always be someone who does something improperly with something and gets injured or killed; are we going to ban these things too? To the list of already banned things we can then add to it with more common and unsuspected items such as:
* Cars
* Pillows
* Petrol
* Alcohol
* Blankets
* Frozen Peas
* Etc etc.
Anything you can imagine in your life someone has been injured or killed by it, so it becomes open season with the banning.
I think we just need to put this back in to perspective, some kid got hurt, big deal. Kids get hurt all the time and it is good for them. Wrapping kids in cotton wool only serves to set them up for bigger failures later in life, as they aren't exposed to realities like "Fall down and mummy or daddy won't come running".

Kids should climb trees and should break bones; it's a great leveller in testing ones' abilities, as well as teaching them a self realised sense of risk, danger and stupidity.
A parent warning of the dangers of climbing a tree are no match for little Johnny falling out from same. If ever anything needed to be banned its self interest groups and governments getting more control of our lives. Who the hell do they think they are?

In short, stop banning everything because one dumb sumbitch hurts himself. Australia is really starting to need an industrial sized can of "Harden the ---- up".

Its great to get some background info on the whole litigation side of things, I wasn't aware that the mid 80's was a lawyers delight, you learn something new everyday. I wasn't around in the mid 80's so that might have something to do with it

Considering we are not allowed to discuss politics (site t&c's), without going down that slippery path, how can we make a positive change to reverse these stupid attitudes and begin to repair the damage done?

With the media jumping at every opportunity for a story, pretty soon they won't have any stories to follow, because all the FUN STUFF will have been banned, largely thanks to their constant witchhunts and bandwagon mentality.

If someone has a modified car, they are a hoon, if someone has P plates, they are a hoon, if some teen was drink driving, wipes themselves and others out, they are worse than the devil himself... unless the mother can be filmed crying on tv... then it's someone elses fault.

Edit: Agreed with LTD, kids need to learn for themselves, it wasn't until I fell out of the big tree in our front yard that I realised you shouldn't climb a tree when its raining.

Also, thank you LTD, I have a new quote for my sig

most of the stuff talked about here is already illegal (explosive devices) so banning components would just make it "double illegal".

"I am going to make a bomb, wait a minute - we cant use sparklers because they are illegal, guess we better not make the bomb then". Like fireworks - find me a kid that cant get fireworks if they have some $$$$.

Unless you lock up kids 24/7 they are going to get up to shenanigans - no matter what you ban. It all comes down to the parents (bad news for some kids but that’s the world we live in).

I remember as a kid we found a farm shed full of detonators and blasting cord, that was fun for a while until we discovered the third missing component - which we used once and decided that was enough.

can every one say Tinnitus

I blame greed and shareholders.
CH9 wants to make more money than CH7 so they come up with a sensationalised story to get more attention, which is all for the shareholder that demands a return each and every year.
Staff at company 'X' learn that if you have a fall, you can sue for compensation. Enter a new OH&S employee to write documents for everyone to read and sign off that they have read, even if they probably didnt read it, so now company 'X' is safe from lawsuits. So now company 'X' has more money for shareholders.

I remember an ad on TV during high school (mid/late 90's) about a kid falling out of a tree and becoming crippled. We made all sorts of jokes about that ad, and we still set up rope swings across creeks (over large rocks mind you). The only thing that stopped us using the rope swing was when it broke during a tandem swing and my mate and I ended up dislodging a couple of decent sized rocks with our *****.
Although we probably would have continued to use it if we had been able to find the money to replace the rope, we just wouldn't have gone tandem again. So something was learned from that event.

And let's not just blame the kiddies...... Put 10 guys on a beach overnight with alcohol and fishing rods and watch the stupidity happen......(yes, i was one of the 10)

Can of aeroguard into the fire and run to a safe distance (well, all except the poor bloke who was asleep next to the fire).

Very spectacular and the guy sleeping didn't even wake up - although he needed a new sleeping bag from all the burn holes.....

Point is, any idiots can take legal products and cause mayhem. You can't ban everything.

Have fun by all means, but if things go wrong, man up and take responsibility......(and as grandpa spec said, don't throw aeroguard in the fire).
