How about all those tests that demonstrate that distraction is equivalent to certain blood alcohol levels when it comes to reaction time and awareness. I don't think you'd let a drink driver off the hook as long as he didn't have a crash.

But hang on.
Was it a Melways she was reading? Was it the operating manual of the vehicle? If it was would that be ok? How many superheroes have rabbited on about how Melways is so much safer than satnav......... And yes this is a bit of sarcasm although I use to freak out passengers in my Seneca by covering the windows with charts when I was flying into the sun in the early morning or late afternoon and telling them I was lost and needed to closely look at all of them at one........ |

Ugg
You have a licence so you should be fully conversant with the laws that pertain to driving. Take the time to look up the rule yourself. It seems that you have a way to go before you are a competent driver who knows the road rules, if you are serious about your statements.

Everyone should do a whip-around and get her an Ipod & an Audible account.
I will be interested to see what the people in this thread will be saying in a few years when Autonomous driven vehicles show up on the scene. |

Better still keep in mind what the 1'st thought that would come to your head about the driver if and when one day you are rear ended. |

Very touching metaphor mate. But fact is she didn't rear end anyone, and she didn't break any laws. Period. |

According to some you were distracted and should have been watching the road ahead instead of taking an inventory of his dinner plate to the side of you. may as well have been reading a book ?

And by the way, reading a map book while driving is illegal and dangerous. Just because people used to do it does not make it safe or legal. As for the "he did not hit anyone", road laws are in essence preventative not reactionary. Everyone who does not see the offence in regards to law and the stupidity of the actions of that driver please proceed to your nearest police station (by foot thanks) and hand in your license. People like that keep me gainfully employed.

Considering that she’s in Victoria, it would fall under the offence of careless driving. If she was involved in an accident and a witness was prepared to make a statement as such, or if the police believe that the charge would stick, she would also cop the added bonus of failure to maintain proper control of a vehicle. Have a read of this. http://www.lawhandbook.org.au/handbo...hp#Ch91Se53922

Ah,some picture taken by some real life hero who has never done anything wrong in his driving life .....
Gimme a break People in glass houses shouldnt throw stones ... We have all done something at least once in our driving life, wether it was a split second distraction, play with the air con knobs, flick a tune or two on the tune box, turn and face the missus or someone else while talking I doubt there is anyone who gets in their car and concentrates 100 % on driving Yes the sheila reading is doin wrong, but isnt the person whos driving the other car worried about the reader than his driving .... Yep,so he could get fined for undue care whilst driving Small minds do small things, people with smaller minds look on |

This could turn into a forum war, however I'm less worried about the fact of the matter being whether it is breaking the law reading a book or not while driving, and more on the fact that it really is common sense to not read a book while driving at 100km/h. Is that something that everyone would agree?
Look if I was driving (let alone on my motorbike) and I saw someone reading a book while driving I would sure as hell get out of the way of them because they would be putting my life in danger, simple as that

I've seen worse. The other week coming down roe hwy was going past a car where I thought he had his arm out the window. Get closer and its his right foot, as I go past have a quick look and its both feet on the dash, smoking a fag and steering with one hand. Txting on the phone is done by a lot of drivers now, its very obvious when there head is looking down and the lights go green and they take a couple of seconds to actually move.

There are also laws pertaining to distracted driving, although i do not remember what they are. It is illegal do drink and drive, eat and drive, and any one of a number of other menial things that are classified as distractions, meaning the attention component of due care and attention. If you need it spelled out in bullet point form, you are either trolling or part of the problem. I need a dash cam for the trucks. The sheer amount of lunacy i witness daily has to be seen to be believed. |

The lady reading was breaking the law as well as not giving a stuff about the well being of those around her and according to some posts the photo taker was breaking the law. This is supposition by the posters and it was done because he does give a stuff about those around him on the road and its a fair bet that in some way they both knew what they were doing could be construed as wrong.
Then we have Ugg who doesn't know that either of them may be breaking the law and doesn't give a stuff but wants everyone on the forum to find the road rules for him rather than look them up himself and when it has been pointed out by many posters that a law has been broken still maintains that it is all ok. I suppose that if he doesn't look it up himself he can still delude himself that he is right rather than prove to himself that he is wrong so that maybe he can keep driving in that manner himself. I can't see any other reason for not looking it up!

Thanks for that...couple of problems with that link (a) It's dated 1949..... (b) It doesn't mention that reading a page of a book falls into that definition If she had a collision etc and the officer at the scene questioned her and she said something like.."I just took my eyes off the road for a few seconds to look at the street directory"...then she might have a problem. But for now I am certain there is no prospect of a conviction and that is all that a police sergeant would be interested in. About all that is certain is that she may have failed the common sense test. To all my good friends above please try to refrain from personal attacks. |

You have demonstrated my point perfectly. Your examples rely on a charge after a collision, or excessive speed. She had no collision, was on the speed limit, therefore your examples are irrelevant. Last edited by flappist; 21-12-2012 at 03:41 PM. |

So rather than enforce a law that is designed to prevent events occurring that may lead to injury and death, you're more than happy to let people do what they want, and only charge them with an offence if injury or death result from their behaviour? Seriously?
