i agree,leave it legal,but i would have sedto the collectors that no one is taking my car.period.,they would have to get the coppers around to hold me back while they took the keys from me then take the car,i would never give up the keys unless i was in cuffs cos then id have no choice

Yes i agree i would done the same, but his still learning like we still are everyday in life but we were at that age too honest too.
What I know now would of been allot better at that age today lol.


Best do it legally you'll be better off in the future, lets not confuse the guy and let it be it according to the law of legal terms and conditions.

Let the Legal Eagles do their bit, and by all means DONT listen to idle chatter from the Police officers they are all wannabe lawyers.
Coppers will always put you off legal proceedings because they know they are already bogged down with paperwork and the courts are full of cases.

Banks are heartless they only see paperwork and their money and how to get it.

Unfortunately you can't take this into your own hands..

Let the law and honesty prevail.
Sopmetimes honesty doesnt come up trumps , but you know you did your best.

i still dont get how you can sell a car to a guy with finance owning, not pay the loan and have the guy who paid you for the car go down and you seemingly get of scot free?

Why doesn't the insurance company just go after him like they would if he was an at fault uninsured driver in a accident?

Same way if you sell a stolen car, the original owner gets it back and the poor guy who paid for it is out of pocket. The finance company owns the car till its paid off.

ok, makes sense from an insurance companies point of view...

...what a bad situation. i too would want to hit the guy but it's not going to get you your money back. I'd be after that Hilux myself, go after any asset the bum may have

A few yrs ago I was about to buy an XR6T for $12K with only 6,000km
on the clock but after a call to REVS he still owes about $32,000!!!

REVS is a god send orelse i would have done my $12k.

I agree Mark. Stupid to post such a thing on a public forum. I don't agree with anyone organising a lynch mob or such things but I do think Daniel has the right to go and confront the guy on this.

The guy gives him a signed piece of paper stating there's no finance and now his car has been repossessed. He has every right to confront him. I know I would! But I wouldn't take a mob. Daniel has a right to know straight from the guy himself why he did this and what he's doing to rectify it so that he can atleast try to get his car back or somehow, get his money back, or part of it.

Has any legal advice been seeked?

I was being sarcastic in relation to how this poor lad should deal with his issue through the courts yet the guy who got a dodgy diff has people doing drive byes and emailing photo's which i would consider antagonising, all for a few hundred bucks.
It's laughable and obviously 99.8% of people see it that way.

ill spell it out for YOU.
one guy has the ability to go around to this guys house - he has been told by the COPS to stay away. he also is in no frame of mind to go around there and rationally sort things out. he will end up in the sh$t - but that seems to be ok by some here.
the other guy does not have the ability to go around to the guys house as he is in a different state. anyone can take a picture of anyone in a public place, the guy sure as hell isnt going to know who took the picture either.
spending a few hundred dollars going to court for a few thousand is one thing.
spending a few hundred dollars going to court to recover a few hundred dollars ISNT going to happen. that is what EBAY protection is for.
did you notice in BOTH threads, i have been CONSISTENT in trying to quash all threatening and violent behavior as it will not get anyone any where.
if you continue to have a problem with this, well thats YOUR problem.
if you want to be a hero and go around and start things - off you go. DO NOT come back here and give us a sob story of how you were arrested, charged or had your jaw broken or whatever.
your just going to get the "told you so" and "you got what you deserved" speech.
seems some people around here cant think for themselves so they have to be told not to do anything illegal FOR THEIR OWN GOOD.

Mate, i never said you were inconsistent, i was simply bringing to light how in one case it's ok to take the law into your own hands and in another it's not.
As i said and from the fact that your the only one going on about it MOST people know exactly where i was coming from.

Lets keep it clean guys don't hate me for it but the guy has lost his car and come to us for help advice and some positive attitude to what has just happened.
I respect we all have different opinions which one makes a good fourum but what we type on a keyboard usually comes out different on anothers screen.
ANy updates on legal terms?
Have you had any news from the cops or from any lawyers solicitors that you have approached?
Advice what will you be doing?
What have you done so far?
Who has approached you for legal support?
What have you done so far that way we all have a better understanding for this thread.
