Default Large Auctions House problems

Has anyone on the forum had trouble with a certain large car auction in Qld regarding money owed to them?

I've been waiting 72 days and keep getting told it's approved but no money

Any ideas on ways to proceed with Qld consumer law?

You need something in Writing from the Auction House.

The story is that I purchased a car but they damaged it prior to me receiving it. They admitted it was their fault and we negotiated a "dollar figure". This was near the end of June.
All communication usually end with "we'll let accounts know" and a promise that they will contact me. One email response was for lack a reply was " I always say if you have nothing to say, say nothing.". They refused to pass on a number for accounts. Its now 77 days
and i'm still waiting

I just had a quick look at the Queensland government's various ministries/departments. The Department of Justice and Attorney General has a section called Fair Trading and Consumer Affairs/Office of Fair Trading.

Contact them.

Are they saying one thing on the phone and another by email?

I believe in QLD you are allowed to record phone conversations.??

Same thing from both. This is the replies I'm getting email and phone

"I have reached out to the auction manager and to our account team to get an update for you.
As soon as I get a reply, I will contact you immediately"

I've always had to contact them to get information (or lack of)

Just ring them up and let them know you have had enough of the run around and if they don't sort it out in this phone call, when you hang up you will be handing it over to a lawyer and all costs incurred for the lawyer to sort it out will be added to the amount.

Have done this a few times now and its amazing how people that were uncontactable come out of the woodwork to sort it

I hope you have written correspondence to back up your claim because what you are saying sounds like the auction house is whitewashing you.
