Default A vl wrote off my ea.....

Was going along scoresby road yesty near knox had a doodle pull out in front of me and a vl next to me, i was outside lane vl was inside, i slammed on the brakes vl locked em up too cept the nong couldnt control his car, hit me sideways pushed me up the gutter into a tree and almost through someones fence, of course the vl drove home needing a bumper and guard and i have a write off, mongrel that caused it all took off....

Hate to be the bearer of more bad news, but unless there was vehicle to vehicle contact with the guy that caused it all you can't hold them liable.

It's a PITA but it's the way things work. I get the same thing all day every day at work.

If thats the case, dosent that mean the VL is at fault for hitting the EA?

bad luck mate looks to be a fair bit of damage, the motor and box would be still salvagable i hope aswell as many other things. oh well, u should be able to get up and going again shortly soon!

If the VL moved into his lane and hit him then the VL is at fault. If there was no contact then as far as the law is concerned no-one else was even on the road at the same time.

Yup. If this call came to me at work, I would place VL at fault. Depending on insurance company though they may class both vehicles at fault but send a letter of demand to the VL driver and see what happens.

The reason they do this is that you can bet your last dollar that the VL driver will say that you lost control and hit him. If there are no independant witnesses this will most likely be an each bear own claim.

EBO means you cover your costs, they cover theirs. If you have insurance it basically means you lose you no claim discount and cough up your excess.

As I said PITA.

Bad news mate, nothing worst than someone else damaging your car and you can't stop it.

At least your insurer will pay you out ASAP and you can get a replacement!

Sorry to here about the accident. I had a VN run a red light a couple of years ago and take me out in my EA. Because of that accident I now have my pride and joy so try and think of it in a positive light.

Thanks for all the support guys, the car that pulled out in front of me and the vl sped off and no one got rego, i have the vl drivers details and im going to pursue further as he came into my lane and hit me....
