it is only legal to buy pornagraphic films/movies from the act or northern territory. there is very limited suppliers and i had thought the northern territory is mail order only. i believe there is one or two legal stores in canberra, but it is not legal to buy them from any other store
that means the nanny state has not taken over yet, because it is not too hard to find them in adult book stores

The question isn't the acquirement of such material in Australia, it is the invasion of privacy on grounds on something that isn't illegal in the first place.

It is quite legal to own it. There was a change to the inbound passenger card that asks if you have any porn now rather than objectionable material.

So now they can go through everything you own looking for playboy mags etc just to check if it's illegal

maybe you know much more about the law than me, but to my knowledge it is only legal to purchase pornographic material for australian use by either going to the stores in canberra or by mail order in canberra or the northern territory
that to me would suggest that adult book stores or international purchases are not legal. the powers that be have turned a blind eye to these two outlets until recently (with international purchases at least)

do they really expect anybody with illegal porn to own up? what a completely ridiculous idea. internet filter, getting people to admit to carrying porn at a crowded customs desk...what is this government going to think of next? the bottom inspectors have to be on the cards, just to make sure you have wiped properly.

What is more important is that people who own perfectly legal porn might me turned into criminals when, through embarrassment, they do not declare something totally legal to own.

Geez, that comment about a bloke and his missus filming themselves doing whatever the hell they want, having to declaer it then sit through a viewing with some random customs officer is insane.

Can you for a moment fathom your wife carrying her laptop that may have had a racy video of you and her on it and having her be forced into sharing a viewing with customs??

I can just imagine the punch-ups now...

Then imagine the family man on holiday with his wife and kids, perhaps the mother inlaw aswell for good measure. He declares a vid or magazine in his bag and his laundry is aired for all and sundry to see.

I don't care about smokes, but the other two...well, that's just essential for staying sane.

I read the article and fail to see how his life was ruined because a hard disk that will likely be returned to him was confiscated to check some possible questionable material...?

Clearly it's to discourage the trafficking of video exploiting children but given that it doesn't need to be brought in on physical media, I'm failing to see the point of checking drive content in the first place.

I travel for work, I'd be stuffed if my laptop/hdd was confiscated for any period of time.

It's an unjust and ineffective law. As already mentioned, if you want illegal porn, there's this new thing called the Internet, and NO filter can/will stop it.

There has been an huge increase in arrests at the border in the last few years in the detection of kiddie porn and to a lesser extent terrorism promotion and other 'objectionable' stuff . (Im calling 4 or 500% offhand in the last few years)
(Yes on physical media Rodp.... people are dumb, and a lot of these people simply dont think in the same ways normal people do)

I have a feeling change to the question was done in the view of making prosecutions in that area easier.
However it seems to have been done by someone with absolutely no clue, planning or thoughts of its actual effects on both Customs and the travelling public.
And clearly no consultation with the people who actually enforce it, as its certainly not going to have a positive effect.... and most jurys these days arent going to beleive the guy who claims 'I didnt know it was there' when he comes back from a dodgy journey.



Im not going to go down the conspiracy theory religious nut K.Rudd path as I tend to think sheer incompetence from Kanberra is more likely..........
but I dont trust anyone like that in power as amply demonstrated in the disaster they are trying to foist on us in the internet censorship regieme.

It is discouraging to hear this happening, I'm going over to NZ in a month and was planning on taking my laptop with me guess I'll clean up the hard drive a bit first.

I do remember about 6 months ago reading an article that said that Australian customs were asking to have greater searching rights for checking incoming and outgoing portable media. They wanted to be able to confiscate MP3 players for a certain period of time to check for illegaly obtained music. Meaning they could take your MP3 player even if it didn't have any illegaly downloaded music on it.

And whats "illegal porn" anyway, other than underage?

There was obviously something on there that was questionable, if there wasn't they wouldn't waste their time on it. They don't need to bring in a specialist, they have them quite readily on hand.

There is plenty of illegal porn out there, think rape etc.
